29 CFR 1910.107(b)(5)(ii): All discarded filter pads and filter rolls shall be immediately removed to a safe, well-detached location or placed in a water-filled metal container and disposed of at the close of the day's operation unless maintained completely in water. On or about November 7, 2023, at an establishment located at 724 South Industrial Drive in Waupaca, Wisconsin; the employer did not ensure that the filter pads used in the spray finishing room were immediately removed to a safe, well-detached location and disposed of at the close of the day's operation. Employees would use pressurized air to blow out the filters at the end of the workdays and reuse the filters for up to two weeks, exposing employees to inhalation hazards presented by the used filters and the blow out process.
