29 CFR 1910.1025(e)(1)(i): For any employees exposed to lead above the permissible exposure limit for more than 30 days per year where engineering and work practice controls (including administrative controls) were feasible but did not reduce the employees' exposure to or below the permissible exposure limit the employer did not use engineering and/or work practice controls to reduce exposures to the lowest feasible level: Long Shot Pistol & Rifle, LLC, 375 County Ave Secaucus, NJ 07094 a) Employees performing Range Safety Officer, customer service, and cleaning activities were exposed to respirable lead concentrations exceeding the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter (ug/m3) by 1.76x, 1.58x, 5.31x, and 2.67x. These exposures, which are equivalent to an 8-hour time-weighted average of 88.2 ug/m3, 80.2 ug/m3, 265.2 ug/m3, and 133.7 ug/m3 exceeded the PEL of 50 ug/m3. The sample times were 316 minutes, 473 minutes, 407 minutes, and 229 minutes respectively. Zero exposure was assumed for the unsampled time periods of 164 minutes, 7 minutes, 73 minutes, and 251 minutes respectively. An employee performed Range Safety Officer activities in the facility was exposed to respirable lead concentrations exceeding the Permissible Exposure Limit (PEL) of 48.9 ug/m3 by 2.82x. The exposure is equivalent to a time-weighted average of 137.9 ug/m3 exceeded the PEL of 48.9 ug/m3. The sample time was 490 minutes. Violation occurred on or about June 3rd, 2023 and June 10th, 2023.
