29 CFR 1910.502(h)(1):The employer did not ensure that each employee was separated from all other people by at least 6 feet when indoors when such physical distancing was feasible. On or about August 10, 2021, the employer failed to ensure that unvaccinated healthcare providers maintained 6 feet separation from other nursing home staff when not involved in direct patient care activities. a) Generations at Neighbors, LLC failed to ensure physical distancing at the main nurses' station. Unvaccinated healthcare providers including, but not limited to, Licensed Practical Nurses (LPNs), Certified Nursing Assistants (CNAs) and Registered Nurses (RNs) spend in excess of 15 minutes per shift in close proximity (less than 6 feet), performing data entry tasks, phone calls, and giving end of shift reports. b) Generations at Neighbors, LLC failed to ensure physical distancing at the Persons Under Investigation (PUI) nurses' station. Unvaccinated healthcare providers including, but not limited to, Licensed Practical Nurses (LPNs), Certified Nursing Assistants (CNAs) and Registered Nurses (RNs) spend in excess of 15 minutes per shift in close proximity (less than 6 feet), performing data entry tasks, phone calls, and giving end of shift reports.
