29 CFR 1926.1427(a): The employer did not ensure, prior to operating any equipment covered under Subpart CC, the person is operating the equipment during a training period in accordance with paragraph (f) of this Section, or the operator is qualified or certified to operate the equipment. On or about February 26, 2020, and times prior thereto, the employer did not ensure employees operating a rough-terrain crane were qualified or certified to operate the equipment. This exposed employees to struck-by hazards.
