29 CFR 1926.1203(e)(2)(iii): The employer did not use a calibrated direct-reading device to test for toxic gases before allowing employee(s) to enter a confined space. (a) On or about 2/5/19 employees working for Highbury Concrete, Inc. at 30 East 29th Street New York, NY 10016, employees were installing formwork within a permit required confined space without a test for toxic gases with a calibrated direct-reading device. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
