29 CFR 1926.964(a)(3)(ii): When a pole is set, moved, or removed near an exposed energized overhead conductor, the employer shall ensure that each employee wears electrical protective equipment or uses insulated devices when handling the pole and that no employee contacts the pole with uninsulated parts of his or her body. a. On or about October 3, 2018, employees were setting an approximately forty-five foot distribution pole beneath an energized 69KV transmission line. The employer did not ensure that employees were protected from electrical hazards while handling the conductive pole in close proximity to the energized conductor.
