29 CFR 1910.178(a)(5): The user did not request, for trucks equipped with front-end attachments other than factory installed attachments, that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. On or about April 24, 2017, at the steel distribution and fabrication facility located at 2400 N.E. 36th Street, Fort Worth, Texas the employer used a Hyundai Model 250D-7E, Diesel fork lift attached with a Brute Lift Boom did not ensure an approved data plate indicating the attachments and the weight and capacity adjustments was affixed or marked on the forklift truck exposing employees to crush-by hazards.
