29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. Location: 210 Bowery Street basement On or about: August 4th 2015 a) The competent person did not remove employees that were working on or in the elevator shaft/excavation. One employee was performing chipping operations in the elevator shaft excavation that was between 8 and 9 feet deep while the other employee was funneling dirt behind wood brace. The elevator shaft did not have adequate protective system and no means were installed to underpin or support an adjacent wall.
