29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE) a- Revised procedures for tanker truck loading were instituted in 2014 that introduced open pouring / straining of hot molten asphalt and manual hose connections, exposing Hot Mix batch operator(s) to the hazard of being splashed / sprayed by molten asphalt at or about 380 degrees Fahrenheit. The employer had not performed a hazard assessment to determine needed personal protective equipment (PPE), such as effective barrier protection for the body, of non-synthetic material, as well as face protection.
