29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about May 16, 2013 and at times prior thereto, employees performing excavation activities were not protected by shoring or other protective systems where the excavation vertical sides were approximately 7 feet high and sloughing. Employees were exposed to cave-in hazards.
