North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)machine bay - for the underhung 5 ton hoist (hoist #3) that was used to lift I-beams, bag houses, and cyclones (weighing up to 5 tons) and was not load rated to determine its load capacity. b)fabrication bay - for the underhung 5 ton hoist (hoist #2) that was used to lift I-beams, bag houses, and cyclones (weighing up to 5 tons) and was not load rated to determine its load capacity. c)fabrication bay - for the underhung 10 ton hoist (hoist #1) that was used to lift I-beans, bag houses, and cyclones (weighing up to 10 tons) and was not load rated to determine its load capacity. d)east fabrication bay - for the underhung 10 ton hoist (hoist #5) that was used to lift I-beans, bag houses, and cyclones (weighing up to 10 tons) and was not load rated to determine its load capacity. e)east fabrication bay - for the underhung 10 ton hoist (hoist #4) that was used to lift I-beans, bag houses, and cyclones (weighing up to 10 tons) and was not load rated to determine its load capacity. f)machine bay - for the 1 ton jib crane (hoist #8) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. g)machine bay - for the 1 ton jib crane (hoist #3) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. h)machine bay - for the 1 ton jib crane (hoist #2) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. i)machine bay - for the 1 ton jib crane (hoist #1) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. j)machine bay - for the 1 ton jib crane (hoist #5) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. k)machine bay - for the 1 ton jib crane (hoist #6) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. l)fabrication bay - for the 1 ton jib crane (hoist #4) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. m)fabrication bay - for the 1 ton jib crane (hoist #7) that was used to lift panels and "C" channel and was not load rated to determine its load capacity. One feasible and acceptable abatement method, among others, to correct this hazard is to determine the load rating for the cranes. Reference: ANSI B30.16-1981, Section 16-2.2.2: Load test shall be performed as outlined in 16-2.2.2.
