Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being throw from a powered industrial truck: (A)Receiving Yard: On or about 11 December 2000, and at times prior thereto, the operator of the Toyota Powered Industrial Truck was not wearing the seat belt which was provided. (B)Tape and Texture: On or about 12 December 2000, and at times prior thereto, the operator of the Toyota Powered Industrial Truck was not wearing the seat belt which was provided. Note: Abatement certification and documentation are required for this item. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO: Train employees to always wear their seat belts and have supervisors check to ensure they are adhering to the training.
