29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) On or about April 28, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure employees were protected from fall hazards while performing work on catwalk platforms at heights greater than 4 feet above the lower ground level. Employees were required to perform maintenance work on lift support and drive system components which included accessing catwalk platforms on chair lifts including, but not limited to, the American Flyer and the Kokomo Express. A means of protecting employees from falling from the catwalk platforms had not been implemented. This condition exposed employees to fall hazards.
