29 CFR 1926.1203(a):Before it begins work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary. (a) On or about December 3, 2024, and at times prior, at 925 19th AVE NW, Birmingham, AL 35215, Gulf Coast Underground, LLC, failed to ensure confined spaces were evaluated by a competent person for characteristics of a permit space when employees entering an active sewer system in preparation for inversion installation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
