29 CFR 1910.1052(g)(2)(i): The employer did not implement a respiratory protection program in accordance with 29 CFR 1910.134 (b) through (m) (except (d)(1)(iii)), which covers each employee required by 29 CFR 1910.1052 to use a respirator: a) On or about October 29, 2024 - Kamesi Corporation - 111 E 100th St. Apt 2B, New York, NY 10029 - Bathroom Employees performing bathtub refinishing are required to wear respirators including but not limited to 3M half-face respirator while using hazardous chemicals including but not limited to Hoodstrip-888 Semi-Paste Remover, which contains 75-90% Methylene Chloride (MC). The employer did not develop and implement a respiratory protection program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
