29 CFR 1926.1153(f)(1):The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible: Location: 8200 JFK Boulevard. North Bergen, New Jersey 07047. a) The employer allowed employees performing concrete grinding activities to dry sweep the work area where such activity could contribute to employee exposure to respirable crystalline silica. On May 14, 2024, an employee conducting grinding activities outdoors was exposed to 51 micrograms per cubic meter, which exceeds the permissible exposure limit (PEL) of 50 �g/m3. The employer was sampled for 155 minutes. Zero exposure is assumed for the remaining 325 minutes. Violation occurred on or around May 14, 2024.
