29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: At a worksite located at or near 39.185939, -93.868953 in Lexington, MO: Employees were exposed to confined space hazards in the performance of their job duties. The employer failed to ensure that a competent person identified all confined spaces in which one or more of its employees had been directed to work in, nor did they identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary. This was last demonstrated on or about March 11, 2024, when employees were working to replace a sanitary sewer pipe inside a concrete vault and where employees used jack hammer to remove a section of concrete wall to access a valve and piping.
