29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toe-boards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. a. Kalmbach Feeds, Inc. - Upper Sandusky, Ohio: On or about January 22, 2024, the employer did not ensure that the ladderway platform hole, located on the Whirley platform of Mix Line #2, was guarded to protect employees from fall hazards of approximately 18 feet and ten inches. b. Kalmbach Feeds, Inc. - Upper Sandusky, Ohio: On or about January 22, 2024, the employer did not ensure that the ladderway platform hole, located on the distributor platform of Mix Line #2, was guarded to protect employees from fall hazards of approximately nine feet and ten inches. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
