29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about August 30, 2023, employees constructing a covered parking area were exposed to a fall hazard when gaining access to the upper landing surface to install the deck boards at 5480 Grant Avenue, Suite 2, Cleveland, Ohio 44125; the employer did not ensure where portable ladders were used for access to the upper landing surface and the ladder's length allowed, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.
