29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. As reference in 29 CFR 1926.103. Location: a) On the second floor of the jobsite at 126 Lafayette Street, New York, NY 10013: On or about March 7, 2023, employees were using handheld power chipping tools to chip into brick walls to demolish them while wearing N-95 respirators. The employer required the employees to use N-95 respirators while performing this task. The employer did not institute a respiratory protection program.
