29 CFR 1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) Franklin Storage, L.P., 900 Kriner Road, Chambersburg, PA - Forklift Charging Area - Employees were engaged in forklift battery charging operations using chemicals including, but not limited to, sulfuric acid. The employer did not develop, implement, or maintain a workplace written hazard communication program therefore exposing employees to hazardous chemicals, on or about February 2, 2023. b)Franklin Storage, L.P., 900 Kriner Road, Chambersburg, PA - Company Wide - Employees were using chemicals including, but not limited to, petroleum-based products during maintenance activities. The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet(s); therefore, exposing employees to chemical hazards, on or about February 2, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
