29 CFR 1910.134(d)(1)(iii):The employer did not identify and evaluate the respiratory hazard(s) in the workplace, including a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form: At the facility at 238 Nonotuck Street, Florence, MA: On and before December 13, 2022, the employer had not evaluated respirable dust hazards in the workplace. An employee performing a color change, maintenance, and other routine production tasks was exposed to an 8-hour TWA of Particulates Not Otherwise Regulated, Respirable Fraction, of 7.55 mg/m3, in excess of the 8-hour TWA permissible exposure limit of 5 mg/m3.
