29 CFR 1926.454(c)(1): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer did not retrain each such employee so that the requisite proficiency is regained. Site: 289 3rd Ave in Brooklyn, NY. a) On or about 11/1/2021, employees used a three-story supported scaffold for access and egress from the roof area. The employees lacked the understanding for safe use of the scaffold, and lacked the proficiency to recognize the fall hazard presented by the gap between the building and the scaffold platform. The employer did not retrain the employees so that the requisite proficiency is regained. An employee fell 20 feet through a gap between the building and the scaffolding resulting in fatal injuries.
