29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards present: a) Truck Unloading Rack: On or about 06/30/2021, and at times prior, an adequate hazard assessment used for the selections of appropriate personal protective equipment (PPE) was not completed at the facility. The employer failed to select, provide and/or enforce the use of PPE by employees working with chemicals/product such as, but not limited to, asphalt. Thermal and respiratory protection may be necessary when unloading asphalt products (e.g.: PG 76-22 and PG 64-22) into semi-truck tractor trailers. b) On or about 06/30/2021, and at times prior, an adequate hazard assessment used for the selections of appropriate personal protective equipment (PPE) was not completed at the facility.
