29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section): (a) Mount Saint Charles Academy - Stairwell adjacent to the service freight elevator serving the school kitchen: On or about 1/10/21, the employer did not ensure that guardrail systems had top rails that were no higher than 42 inches (plus or minus 3 inches) above the stair treads, exposing employees to fall hazards of up to 14 feet while using the stairs to access the freight elevator and outside trash dumpsters: 1) The upper stairwell top rails were 48 inches above the stair treads, 2) The lower stairwell top rails were 33 inches above the stair treads.
