29 CFR 1926.1203(d): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with �1926.1204 implemented at the construction site: (a) On or about 2/5/19 employees working for Highbury Concrete, Inc. at 30 East 29th Street New York, NY 10016, were installing formwork within a permit required confined space without a permit space program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
