29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to items (d)(3)(i) through (d)(3)(vi) of this paragraph. a). Shelling Plant, Warehouse 1, 2, 3, and 5 - On or about and times prior to March 7, 2017, the employer did not develop and implement procedures for safe entry into permit spaces such as peanut dump pits that included elements such as, but not limited to: specified acceptable entry conditions, testing/monitoring of the space for atmospheric hazard(s), control protocols for atmospheric hazard(s), ensuring acceptable conditions existed throughout the duration of the entry, and rescue procedures for rescuing entrants in the space, thus exposing employees to an atmospheric hazard.
