29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about October 12, 2016 the employer did not develop or implement a globally harmonized system (GHS) written hazard communication program where employees in the deli department were exposed to commercial cleaning chemicals including but not limited to, "KAY" Dazzle cleaner and polish, "Kay" pot and pan detergent, "KAY" Kayquat, "Kay" multi-surface and glass cleaner, "Laura Lynn" bleach, "KAY" Hawk fryer cleaner/degreaser, "Ecolab" retail chlorinated cleaner, "Ecolab" quaternary disinfectant, "KAY" block whitener, "Ecolab" Victory water additive for pathogen reduction or "Ecolab" Greasestrip Plus. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
