29 CFR 1910.132(d)(1)(i): The employer did not have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment: Yard: Where the hazard of being struck by vehicular traffic was identified, the employer did not ensure all employees moving through the high traffic areas were using a reflective safety vest. Or, IN THE ALTERNATIVE: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Yard: Where the hazard of being struck by vehicular traffic was identified, the employer did not ensure all employees moving through the high traffic areas were using a reflective safety vest.
