29 CFR 1910.119(k)(2): The employer did not assure that the fire prevention and protection requirements in 29 CFR 1910.252(a) (specifically 1910.252(a)(2)(vi)(C) & 1910.252(a)(3)(i)) have been implemented prior to beginning the hot work operations. On April 17, 2013 or at times prior thereto in the Catalytic Hydrodesulfurization Unit 2 (CHD-2), at the ExxonMobil Beaumont Refinery Complex, the employer did not prohibit employees from flame cutting flange bolts on the E-1 Exchangers which contained residual hydrocarbon.
