Text For Citation: 01 Item/Group: 003 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees limb trees that are not stable or become unstable during tree cutting operations: (a) 111 Reservoir Road, Beckley: Using a Stihl Magnum chainsaw, an employee removed limbs from a 22 1/2" diameter tree that had fallen onto a residential home during a storm. The tree log was not blocked to prevent rolling. As limbs were removed from one side of the tree log, the tree became unstable and rolled onto the employee resulting in crushing injuries, as determined on March 19, 2013.
