29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: Jalpa Construction Corporation - Employees were exposured to noise concentrations which exceeded the values in Table D-2 of this standard. Employees were not protected by an effective hearing conservation program. An effective hearing conservation program includes at least: (1) Monitoring of employee noise exposure; (2) The institution of engineering, work practice and administrative controls for excessive noise; (3) The provision of each overexposed employee with an individually fitted hearing protector with and adequate noise reduction rating; (4) Employee training and education regarding noise hazards and protection measures; (5) Baseline and annual audiometry; (6) Procedures for preventing further occupational hearing loss by an employee whenever such an event has been identified; (7) Recordkeeping. a) An employee who was operating a pneumatic air drill during road construction operations. The employee was exposed to a continuous noise level at 159.5% of the allowable 8-hour time weighted average sound level (90 dBA). The equivalent dBA level of 159.5% is approximately 93.4 dBA. The sampling was performed for 263 minutes during one shift on April 26, 2012. Zero exposure was assumed for the unsampled period of 217 minutes. b) An employee who was operating a pneumatic air drill during road construction operations. The employee was exposed to a continuous noise level at 314.5% of the allowable 8-hour time weighted average sound level (90 dBA). The equivalent dBA level of 314.5% is approximately 98.5 dBA. The sampling was performed for 320 minutes during one shift on April 26, 2012. Zero exposure was assumed for the unsampled period of 160 minutes. c) An employee who was operating a pneumatic air drill during road construction operations. The employee was exposed to a continuous noise level at 201.8 % of the allowable 8-hour time weighted average sound level (90 dBA). The equivalent dBA level of 201.8 % is approximately 95.1 dBA. The sampling was performed for 309 minutes during one shift on April 26, 2012. Zero exposure was assumed for the unsampled period of 171minutes.
