North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by hazard due to lack of training for operators of the electric powered hoist: a)facility, yard, boat hoist - the operator of the electric powered hoist was not provided with instruction in the operation of the hoist. b)facility, yard, boat hoist - the electric powered hoist was not provided with an instruction manual. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to provide information and training on the hoist in accordance with ASME B30.16-2007, section 16-3.1.1 Before Operating Hoist and 16-1.2.17 Manual.
