Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from falls from heights, struck-by, and caught in between: At the worksite: On or about December 26, 2009, and at times prior thereto, the employer allowed operation of a drilling rig with a derrick of unknown manufacturer and load rating capacity without developing inspection, maintenance and repair procedures. Employees were exposed to the hazards associated with falls from heights, struck-by, and caught in between. Among others, one feasible and acceptable method of abatement would be to comply with American Petroleum Institute (API) Recommended Practice 4G, Recommended Practice for Use and Procedures for Inspection, Maintenance, and Repair of Drilling and Well Servicing Structures; Section 4.1.2 User/Owner Procedure Development.
