Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees required to wear tight-fitting face piece respirators were not fit tested prior to use: a.At the workplace, the employer did not ensure that an employee required to use a tight-fitting face piece respirator while working in the compost buildings was fit tested prior to initial use and annually there after. The respirator worn by the employee was 3M's 6300 with the 6004 filter. Among other methods, one feasible and acceptable method to correct this hazard is to fit test employees required to use tight-fitting face piece respirators prior to initial use and annually there after as outlined in the American National Standard for Respiratory Protection (ANSI Z88.2-1992), Sections 4.5.6 and 9.1.4.
