Text For Citation: 01 Item/Group: 003 Hazard: DUST&FUMES
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, and other explosion hazards due to air-material separators being located inside of buildings: (a) For the employees working in the packaging building where the bag bailer dust collector was inside the building and did not have deflagration venting ducted to the outside, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. (b) For the employees working in the packaging building where the bag bailer cyclone was inside the building and did not have deflagration venting ducted to the outside, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. (c) For the employees working in the coal transfer head house where the coal conveyor belt dust collector was inside the building and did not have deflagration venting ducted to the outside, at American Crystal Sugar Company, located at Rural Route 2, Hillsboro, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the NFPA 654, National Fire Protection Association - Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, Section 7.13.1.1.1, including, but not limited to, locating the dust collector outside of the building or providing suitable explosion protection.
