Text For Citation: 01 Item/Group: 003 Hazard: FALLING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of 6-10 above ground level: At the plant, on June 1, 2009, and at times prior thereto, employees were exposed to fall hazards of 6-10 feet above ground level in the cooker area. The employer did not ensure the suitability of the fall protection system in use while employees performed maintenance activities. Among other methods, a feasible means of abatement would be the installation of effective fixed fall protection systems in the cooker area, and to ensure the use of a fall protection system at all times when employees are exposed to falls greater than four feet.
