Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards on June 18, 2007 when employees involved in an oil and gas drilling operation were required to handpush two 18-foot elevator bails suspended by an eight part braided cable sling with an open throated sliding choker hook into position on the rig floor. Among other methods, one feasible and acceptable abatement method to correct this hazard is to utilize the following procedures for all bail handling: (1)Bails will always be picked-up or laid-down one bail at a time, and (2)Synthetic round slings of sufficient load rating will be used with the bottom-end choked below the eye of the bail and top-end shackled to the underside of the hoist swivel.
