Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosions: a) On or about May 16, 2007 and at times prior, Superior Well Service Inc. did not ensure that employees were protected from explosions. Electrical storms were in the area where explosives were being loaded. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to suspend all blasting operations in accordance with the Explosives Regulations of The Colorado State Division of Oil and Public Safety, Section 6.1(H). A useful tool to use when determining to shut down a blasting operation would be a storm and lightning detector.
