North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)Facility: Employees authorized as Operators for the two pedestal mounted jib crane hoist systems present in the facility have not received appropriate training. REFERENCE:ANSI/ASME B30.11-1998 - Monorails and Underhung Cranes Chapter 11-3 - Operation: Section 11-3.1: Qualifications for, and Conduct of, Operators: 11-3.1.1 Operator of Cranes or Carriers: a)Equipment shall be operated only by the following personnel: 1)designated persons; 2)trainees under the direct supervision of a designated person; 3)maintenance and test personnel, when it is necessary in the performance of their duties; 4)inspectors. 11-3.1.3 Qualifications for Operators of Floor-Operated Cranes or Carriers: Personnel shall be required by the employer to pass a practical operating examination. Qualification shall be limited to the specific type of equipment for which examined. NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a training program for those employees designated by the employer to operate one or both of the two pedestal-mounted jib crane/hoist systems present in the facility. The training program shall conclude with a practical operating examination to verify that designated personnel can operate the hoist/s in a safe manner.
