Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Construction Site: The Terex Aerial Scissor Lift, serial number 99360123, operator could not read or understand the manufacture's operating instruction and user's safety rules printed version. Among other methods, one feasible and acceptable abatement methods to correct this hazard is: To comply with ANSI/SIA 92.6, paragraph 7.7(1) through 7.7(4), insure the operator has been instructed by a qualified person in the intended purpose and function of each control, read and understand the manufacturer's operating instruction and user's safety rules.
