Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being struck by the Jarraff Mechanical Tree Cutter's rubber tires due to being allowed to ride on the equipment's diesel tank. (a)Southern Natural Gas Pipeline Mile Post 34.600, T2N, R9E, Section 26, Smith County, MS - On or about July 8, 2005, employee(s) were exposed to fatal injury while being allowed to ride on the Jarraff Mechanical Tree Cutter's diesel tank while it was traveling. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees from riding on the machine who are not properly seated and restrained in approved seats provided by the equipment manufacturer.
