Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing injuries/death when allow to operate a self propelled elevating work platform with a defective lift control were not taken out of service. The employer failed to removed the platform lift from service or repair when safety defects were found as required by American National Standard Institute for Self-Propelled Elevating Work Platforms; ANSI/SIA A92.6-1999: Section 7.3 Inspection and maintence; Users shall inspect and maintain the aerial platform as required to ensure proper operation. Aerial platforms that are not in proper operating condition shall be immediately removed from service.Section 7.10(11): The user shall direct the operator to immediately report to a supervisor any problem(s) or malfunctions(s) that become evident during operation. The user shall ensure all problems and malfunctions are repaired prior to continued use. Section 7.3.3-Prestart inspection: Before use each day or at the beginning of each shift, the aerial platform shall be given a visual and functional test including but not limited to the following; Safety devices. The owners manual affirms proper inspection and maintenance. (a) On or before April 3, 2004, the employer allowed the Marklift elevating work platform to be operated when the control lever for up/down was noted to be defective and not working properly. (b) Inspections were not conducted and documented prior to the last operation of the Marklift. Among other methods, feasible and acceptable methods to correct this hazard: Train maintenance and employees to properly inspect each platform lift prior to use/shift and remove from service any lift found with defects until properly corrected.
