Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between and crushed by rail cars: (a)On or about 03/05/2003 - Coal Dump - Employees were exposed to caught between and crushing hazards, where, they position themselves between unsecured rail cars and attempt to uncouple them by hand when cut levers are missing or in disrepair and the cars are subject to movement. Among others, a feasible and acceptable means of abatement would be for the employer to ensure that cut levers are repaired and prohibit employees from attempting to uncouple rail cars by positioning themselves between the cars.
