North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: ANSI B30.20-1985 Below the hook lifting devices - Section 20-1.2 Markings (a) Rated Load - shall be marked on the main structure. (b) Identification - a nameplate or other means shall be affixed permanently displaying the manufactures name, serial number, lifter number and rated load. a)facility, at Marshall Phelps hoist - below the hook lifting devices did not have the rated load markings along with a permanent identification plate or markings to show the manufactures name, serial number and lifter weight.
