North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)unsafe operation of equipment/machinery. The employer did not have a program for inspecting equipment being used to ensure that all parts, component equipment, and safeguards were in safe condition for operation prior to the malfunction of the rear loader container latchup mechanism at the time of the accident on July 30, 1997 at Hobgood Academy. Ref ANSI Z245.1 paragraph 6.1 c)! "Among other methods, one feasible and acceptable abatement method to correct this hazard is establish and follow a program of periodic and regular inspections of equipment. This includes reports of malfunctions and maintenance work performed."
