Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of electric shock, burn or electrocution where the use of an ungrounded or potentially defective power tool or appliance could occur: The following condition contributed to the existence of this hazard: (a)M/V Independence, main switch gear area: An electrical outlet was improperly wired and indicated that the hot wire was connected to the neutral terminal. Note: One feasible means of abatement, among others, is to rewire and test the outlet for proper wire connections at the terminals before use.
