NYSLL Article 2, Section 27a(3)(a)(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public sector employment havbe been recognized: NYSTA Canal Corp-Employees of the Canal Corp are exposed to electric shock and electrocution through incidental contact with damaged electrical cable aboard water craft. Reasonable and feasible abatement methods include, but are not limited to, replacing the damaged cable. (a) NYSTA Canal Corp-The electric cable in the engine room of Derrick Boat #4 running from the 120 volt generator to a wall panel had its insulation damaged and repaired with electrical tape, resulting in the possible exposure of live parts.
