Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling and felled trees and limbs: a)Line clearance tree trimming, off of Raquette River Road, on or about 02/27/98: Employee not directly involved in the removal of a sugar maple tree, approximately 36 feet tall was in such proximity to be exposed to a struck-by hazard. b)Line clearance tree trimming, off of Raquette River Road, on or about 02/27/98: Employee not directly involved in the removal of a poplar tree approximately 29 feet tall was in such proximity to be exposed to a struck- by hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to keep at a safe distance all employees not directly involved in the removal of the subject tree.ct
