29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): (a) On or around August 20, 2025, the employer did not ensure that it had a written hazard communication program that contained the methods it would use to inform contract employees of Fiske Incorporated, dba High Plains Robotics with necessary information on chemical hazards that may be present while performing work in and around manure. Specifically, the employer did not inform contract employers about the toxic gas hazards present with manure, did not provide Safety Data Sheets (SDS) for potentially present gases including but not limited to, hydrogen sulfide, methane, ammonia, and carbon dioxide, nor did they use appropriate hazardous labeling or establish precautionary and emergency measures to prevent employee overexposure. (b) On or around August 20, 2025, the employer did not ensure that it had a written hazard communication program that contained the methods it would use to inform contract employees of HD Builders LLC with necessary information on chemical hazards that may be present while performing work in and around manure. Specifically, the employer did not inform contract employers about the toxic gas hazards present with manure, did not provide Safety Data Sheets (SDS) for potentially present gases including but not limited to, hydrogen sulfide, methane, ammonia, and carbon dioxide, nor did they use appropriate hazardous labeling or establish precautionary and emergency measures to prevent employee overexposure.
